Purchase Terms and Authority to Utilize Plans

This agreement is made between AustralianFloorPlans.com.au (“Provider”) and the client (“Client”) upon the Client purchasing a selected home design and, by doing so, agreeing to all terms of this Agreement.

 

1. Provision of Design Package

Upon confirmation of payment and cleared funds, AustralianFloorPlans.com.au agrees to provide the purchased home design package to the Client via email.

All prices listed on the website are inclusive of Australian GST.

The home design package includes:

1. A set of scaled floorplans in A3 PDF format with dimensions.

2. A set of scaled front, rear, and side elevations showing wall heights, roof pitch, and dimensions in A3 PDF format.

3. A set of adjustable CAD (Computer-Aided Design) files in AutoCAD DWG format.

4. A generic AustralianFloorPlans.com.au construction specification.

5. A colour 3D front façade image of the design.

 

2. License and Use

The Client and any builder engaged by the Client agree that use of the purchased home design is governed by a limited licence, which:

• Grants use of the design, including AustralianFloorPlans.com.au copyright, for the Client’s personal building purposes at one nominated building site only.

• Must be used under the builder’s own licence and insurance.

• Allows adjustments, additions, and modifications necessary to gain local authority approvals and progress through building licence and construction stages.

• Ensures ownership of additional structural or working drawings derived from the design, or new material drafted by the Client or builder, belongs to the Client or builder for construction purposes only. Design copyright remains with AustralianFloorPlans.com.au.

• Prohibits sale, resale, commercial use, promotional use, or reproduction (partial or full) by any party outside the terms of this Agreement.

The licence automatically expires once construction of the Client’s home is complete.

 

3. Copyright

• All original design content and any variations based on that content remain the property of AustralianFloorPlans.com.au.

• The purchasing of a design is non-transferable and non-refundable.

• All designs, floorplans, images, and content on AustralianFloorPlans.com.au’s website are protected under copyright law. Unauthorized copying, redistribution, or reproduction is prohibited and subject to legal action.

 

4. Client Responsibilities

• Clients acknowledge that purchased design packages are not full construction drawings and do not constitute approval to build.

• Clients and/or their builders are fully responsible for:

  • Adjusting designs to comply with local building codes, site conditions, and regulatory requirements.

  • Obtaining any required structural drawings, permits, approvals, and licences at their own cost.

  • Ensuring the design is accurate for approval and construction purposes.

• AustralianFloorPlans.com.au holds no responsibility for noncompliance, non-conformity, or errors in design implementation.

• Slight variations may exist between website dimensions and those in the supplied design package.

 

5. CAD Files

• AutoCAD DWG files are provided for ease of modification and compatibility with most architectural, building, and drafting software.

• AustralianFloorPlans.com.au does not guarantee compatibility with all external software or systems.

• Clients accept designs as supplied; responsibility for further use lies solely with the Client and/or builder.

 

6. Indemnity

The Client agrees to hold AustralianFloorPlans.com.au harmless and fully indemnified from any claims, liabilities, losses, costs, or legal action arising from:

• Use or modification of the purchased design.

• Building compliance, structural integrity, or local authority approval processes.

 

7. Acknowledgment

By purchasing a design, the Client acknowledges that they have read, understood, and agreed to the terms outlined in this Agreement.
